These Terms and Conditions (“Terms”) govern the use of eTabs, a payment platform operated by eTabs Technologies (Pty) Ltd, a company registered in South Africa. By accessing or using eTabs, you agree to be bound by these Terms. If you do not agree with these Terms, you are not permitted to use our services.

1. Acceptance of Terms
By accessing and using eTabs, you acknowledge that you have read, understood, and agree to comply with these Terms. Continued use of eTabs constitutes your acceptance of any changes to these Terms.

2. Services Provided
eTabs provides a web-based platform enabling restaurant patrons to pay and split their bills via mobile phone. Payment processing is facilitated through third-party payment gateway providers. eTabs does not store or process sensitive payment information such as credit card details directly; such data is managed by the third-party providers.

3. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use eTabs. By using the service, you represent and warrant that you meet these eligibility requirements.

4. Payment Processing
Payments through eTabs are processed by third-party payment gateways. eTabs is not responsible for any delays, errors, or failures in payment processing that arise due to issues with these external providers. Your use of these services is subject to the terms and conditions of the respective third-party payment gateway providers.

5. User Responsibilities
As a user of eTabs, you agree to:
• Provide accurate, current, and complete payment information.
• Ensure that any payment method used is valid and has sufficient funds to cover the transaction.
• Comply with all applicable laws and regulations in connection with your use of the platform.

6. Fees and Charges
eTabs charges a service fee for using the platform to settle bills. These fees will be clearly displayed prior to payment. Vendors (Restaurants or Hotels) may impose a service fee or convenience charge for using eTabs to settle bills. These fees will be clearly displayed prior to payment. eTabs is not responsible for any additional fees imposed by your financial institution or payment provider.

7. Refunds and Disputes
Refunds, where applicable, are subject to the refund policies of the restaurant. etabs does not process refunds directly. Any disputes concerning payments should be addressed directly with the restaurant or your financial institution.

8. Limitation of Liability
To the fullest extent permitted by law, etabs and its affiliates shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of etabs. This includes, but is not limited to, loss of data, profits, or revenue, whether based in contract, tort, or otherwise.

9. Termination
etabs reserves the right to suspend or terminate access to its services without prior notice in the event of a breach of these Terms, suspected fraudulent activity, or any other misuse of the platform.

10. Privacy
etabs collects data such as personal details, payment information, and usage data to process payments, improve services, and comply with legal obligations. Third-party payment processors and service providers may access your information to complete transactions or provide support, but etabs does not sell your data. Security measures are in place to protect your information, which is retained only as long as necessary.

11. Third-Party Links
etabs may include links to external websites or services operated by third parties. etabs has no control over these external sites and accepts no responsibility for their content or practices. Access to and use of third-party websites is governed by their respective terms and policies.

12. Amendments to Terms
We reserve the right to modify or update these Terms at any time. Any such modifications will be effective immediately upon posting. By continuing to use etabs after changes have been made, you agree to the revised Terms.

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
